His actions led to the recovery of 20 billion dollars for United States tax payers and earned him a 104 million dollar whistleblower award. His disclosures could have brought much more good to the world, but our government leader’s decision to not go after additional incriminating evidence prevented justice from being served. A disappointment that is shared by many members of congress, the SEC, and the IRS as evidence by their cooperation and protection measures provided to Birkenfeld. Even so, the Justice Department vengeance was fierce. Although investigations prompted many new reforms in the law and 15 billion dollars of tax funds were recouped, Birkenfeld was the only one that served time. Not a single criminal or bank executive involved in hiding funds has been prosecuted, but the judge did give Birkenfeld 40 months in prison even though the prosecutor recommended only 30 months.
